    Yet another great post on VA mechanic’s lien law. The 43-11 notice is underused and rarely even comes up. Most of the time for the reason that a sub or supplier does not wish to annoy those that carry the money. However, on a new project for a relatively unknown owner or general contractor, this notice can be invaluable.

    One more point to be made here is that the failure to provide a lien notice in these circumstances can be fatal as well. Make sure that all of your clients check the building permit as a first step on any residential project.

  • Virginia’s Interesting 150 Day Rule
    Great post! Just to clarify the 150 day lookback is from the date of lien or last day of work whichever is later. So if the project takes less than 150 days you can catch it all.

    You sure have been busy! VA mechanic’s liens are quite powerful. However, as astutely pointed out in your other posts here, the requirements are as technical as the tool is strong.

  1. I think that more lien filings are inevitable. Followed by more foreclosures unfortunately. The issue in VA will be that the owners may pay what they owe, preventing a foreclosure that may be the only way to turn a judgment into money.

    • Hey Chris. That’s a good point about VA law and the so-called “payment chain.” We have a post on the VA Payment Chain, and the rule that owners must only pay for a project once, scheduled in the next few days.

      But you’re right about the problems facing contractors who file liens late, or in Virginia even those who file it on-time, but just after the owner has depleted all of its funds.
